Activia Ad Claims Under Legal Scrutiny

Yogurt maker Dannon is being sued by Trish Wiener for misleading advertising. Wiener claims that she purchased Dannon’s Activia, Activia Light, and DanActive brand yogurt to help improve her digestive system. Dannon’s ads for the products claim that the yogurt regulates digestion and improves the immune system. The products cost 30% more than competing brands. Wiener claims she trusted that the company’s ads would faithfully represent the products. Her class-action suit alleges that Dannon should compensate her for spending more than she normally would for yogurt. Los Angeles Times, Jan. 24, 2008
